1. GENERAL PROVISIONS
1.1. These General Terms and Conditions regulate the relationship between the user,
hereinafter referred to as the "User," and [Mobility Partners Ltd.], hereinafter referred to as
the "Company" or "MOBY TAXI," regarding the use of the application provided by the
Company (hereinafter referred to as the "Application") for booking and using taxi services
via an online technological platform that electronically processes taxi service requests from
licensed taxi providers.
1.2. By installing the Application, the User declares that they have read, accept, and agree to
be bound by these General Terms and Conditions, as well as the applicable legislation.
1.3. The Company reserves the right to modify or supplement these General Terms and
Conditions in a manner deemed reasonable for the development and improvement of service
quality. The changes take effect upon their publication in the Application or on the official
Company website (www.mobytaxi.bg).
2. SERVICE DESCRIPTION
2.1. The Application is a technological platform that facilitates the connection between Users
and independent taxi service providers (hereinafter referred to as "Drivers").
2.2. The Company is not a transport service provider and does not participate in the contract
between the User and the Driver. The Company's role is limited to providing access to the
Application.
2.3. The User may use the Application to request taxi services by providing information
about the starting and ending points of the journey.
2.4. The Application enables the User to send a taxi service request to an indefinite number of
service providers. It utilizes GPS functionalities to locate the User at the time of request
submission and sends the information to an available taxi provider. The system assigns taxi
orders based on the proximity of available vehicles to the User's specified location. The User
bears full responsibility for the accuracy of the address provided.
2.5. The Application visualizes a suggested route based on publicly available mapping data
but does not guarantee accuracy due to real-time road conditions.
2.6. The User agrees that the Company may modify the user interface, functionalities, or
other aspects of the Application at any time without prior notification. Differences in the
Application's interface and functionalities may exist depending on the operating system used.
3. COMPANY RESPONSIBILITIES
3.1. The Company is not responsible for:
• The quality, safety, accuracy, or execution of taxi services provided by Drivers.
• The conduct, actions, or omissions of Drivers, including delays, service refusals, or
damages caused by them.
• Technical issues related to the User's internet connection or device.
3.2. The Company reserves the right to suspend access to the Application temporarily or
permanently without prior notice and without owing compensation to Users.
4. USER OBLIGATIONS
4.1. The User undertakes to:
• Provide accurate and complete registration information (full name, phone number,
email address).
• Use the Application in compliance with these Terms and applicable laws.
• Not damage or modify the Application or interfere with its functionality.
• Pay for taxi services directly to the Driver using the chosen payment method.
• Verify that the taxi's license plate matches the one displayed in the Application before
boarding.
• Be ready for pickup within five (5) minutes after ordering a taxi, unless otherwise
arranged.
4.2. The Company reserves the right to terminate a User's access to the Application without
prior notice in case of a violation of these Terms.
5. PAYMENTS AND TRANSACTIONS
5.1. Users may pay for taxi services in cash or via electronic payment methods (debit/credit
card) registered in the Application.
5.2. By using electronic payments, the User agrees that the Company processes payments
through licensed payment service providers. The Company does not store payment card
details.
5.3. The User must ensure sufficient funds for transactions. In case of payment failure, the
Company reserves the right to restrict access to the Application.
5.4. By ordering a taxi using a debit/credit card, the User accepts the General Terms and
authorizes MOBY TAXI to deduct the applicable fees.
5.5 Terms of loading and use of an electronic wallet (Wallet)
5.5.1 Nature of the service
Moby Taxi provides a digital platform that allows users to voluntarily load funds into an electronic wallet ("Wallet") for the purpose of facilitating payment for services requested through the application.
The electronic wallet does not constitute a bank account, payment account, electronic money or deposit within the meaning of the Payment Services and Payment Systems Act (PSPA) and applicable European legislation (PSD2).
5.5.2 Voluntary loading and informed consent
Loading funds into the Wallet is carried out at the express request and initiative of the user, after familiarization with and acceptance of these terms.
The user confirms that he understands that:
• loading is not mandatory for using the platform;
• the funds are used only within the Moby Taxi application.
5.5.3 Payment Processing (PSD2 and Stripe)
All payments are processed by a licensed payment service provider – Stripe, in accordance with the requirements of PSD2 and applicable regulatory security standards.
Moby Taxi does not store or process payment card data, nor does it act as a payment service provider.
5.5.4 Non-refundable funds
The amounts loaded into the electronic wallet are non-refundable, as they represent a prepaid value for future use of the services, except in cases where:
• a refund is expressly provided for by applicable law; or
• there is a proven technical error that led to an unlawful or duplicate payment.
The lack of completed orders or the temporary absence of available drivers does not constitute grounds for a refund.
5.5.5 Lack of guarantee of service availability
Moby Taxi does not guarantee that drivers will be available at any time or that every order will be fulfilled.
The availability of services depends on independent third parties (drivers) who are not employees or representatives of Moby Taxi.
5.5.6 Term and use of funds
The loaded funds:
• have no expiration date;
• can be used at any time to pay for orders placed through the application;
• cannot be withdrawn in cash, transferred or used outside the platform.
5.5.7 User responsibility
The user is fully responsible for all actions performed through his account, including loading and using funds in the Wallet.
5.5.8 Changes and termination of functionality
Moby Taxi reserves the right to modify, temporarily limit or terminate the functionality of the electronic wallet, in compliance with applicable legislation and without this giving rise to an automatic right to a refund of funds.
5.5.9 Applicable law
These terms and conditions are interpreted and applied in accordance with Bulgarian legislation, including the Consumer Protection Act, the Payment Services and Payment Systems Act and relevant European law.
*By starting the procedure for loading funds into the electronic wallet, I confirm that I am familiar with and accept the terms and conditions for loading and using the electronic wallet and understand that the funds are not subject to refund, except in cases expressly provided for by law.
6. RESTRICTIONS
6.1. The User is prohibited from using the Application for:
• Sending illegal content.
• Causing harm or inconvenience to other Users, Drivers, or third parties.
• Actions violating moral standards or laws.
6.2. The Application is provided "as is," with no guarantees regarding uninterrupted service,
functionality, or compatibility with the User’s device.
7. RATING SYSTEM
7.1. The User has the right to rate Drivers and services provided, ensuring objective and
reasonable assessments.
7.2. The Company reserves the right to remove unjustified or offensive ratings.
